Terms of Service

These Terms of Service (the "Terms") are an agreement between the business that registers an account (the "Customer," "you") and Fuelviews, Inc. ("Fuelviews," "we," "us"), the operator of Provessa Price Calc (the "Service"). You accept these Terms by setting up a business in the Service; we record the version you accepted, the time, and the IP address of the request.
1. The Service
The Service lets you build a price calculator for the work you do, place it on your own website or on a hosted page we provide, and receive the details of visitors who choose to leave them. Estimates shown by your calculator are produced from rates and rules that you control.
2. Your account
You must provide accurate business information, including at least one of a business phone number or email address — visitors are shown this contact information in circumstances described in Section 4. You are responsible for activity under your account and for keeping credentials confidential. Seats you invite are your responsibility.
3. Plans and billing
- Prices, plan limits, and what each plan includes are stated on the pricing page and the billing screen at the time you subscribe. Those surfaces, not this document, are the source of the numbers.
- Paid subscriptions are billed in advance, monthly or annually, through our payment processor, Stripe. We do not store card numbers.
- Subscriptions renew automatically until cancelled. You can cancel at any time; cancellation takes effect at the end of the paid period, and the account then continues on the free plan.
- If you downgrade to a plan that allows fewer calculators than you have, you choose which calculators remain active. Nothing you built is deleted by a downgrade.
- Fees are non-refundable except where the law requires otherwise.
4. The free plan and the lead cap
The free plan includes a monthly cap on captured leads. When the cap is reached, your calculator keeps working and visitors still receive their estimate; the Service stops collecting their contact details and instead shows them your business phone number or email address so they can reach you directly. Details of visitors who priced a job past the cap are never collected or stored, and cannot be retrieved later. The Service reports the number of such estimates so you can judge a paid plan on real numbers.
Calculators on the free plan display a "Powered by Provessa Price Calc" badge. Removing or obscuring the badge on a free plan is a violation of these Terms.
5. Estimates are estimates
The Service computes price ranges from rates, multipliers, and rules that you configure, applied to answers a visitor gives. An estimate is not an offer, a quote, or a contract, and we are not a party to any transaction between you and your customers. You are responsible for the accuracy of your rates, for reviewing starting rates the Service suggests (including any produced by the AI builder), and for how you honor, revise, or qualify estimates with your customers. We make no representation that any estimate reflects the actual cost of any job.
6. Visitor details and your legal responsibilities
Details submitted through your calculator (each, a "lead") are collected on your behalf and belong to you. Our handling of them is governed by the Data Processing Addendum, which is part of these Terms.
- The Service records each visitor's consent choice together with the disclosure text shown, its version, a timestamp, IP address, browser user agent, and the page reported by the widget. These records exist so that you can evidence consent.
- You are solely responsible for how you contact leads and for complying with the laws that apply to that contact, including the Telephone Consumer Protection Act, state telemarketing laws, and CAN-SPAM. Consent recorded by the Service is consent to be contacted by the named business; it is not legal advice about what any law permits.
- If you enable follow-up emails, they are sent on your behalf and every message includes a working unsubscribe link. You must not use the Service to send messages to people who have opted out.
7. Rate data you share
Unless you opt out, we use anonymised corrections you make to suggested rates to improve the starting prices we suggest to other contractors in your area. Identifying information is removed at the moment of collection, before storage: what you charge is never linked to your business, never shown to anyone, and never sold. You can opt out at any time in your business profile, and opting out stops future collection immediately. This is described at signup because we think it should be seen, not found.
8. AI builder
On plans that include it, the AI builder drafts calculator configurations from descriptions you provide. Your inputs to the AI builder are processed by our AI provider (Anthropic) to produce the draft. Drafts are suggestions: you are responsible for reviewing every rate and rule before publishing. Lead details are not sent to the AI provider.
9. Acceptable use
You must not:
- use the Service for any unlawful purpose, or to collect details of people you have no lawful basis to contact;
- misrepresent who is collecting a visitor's details, or embed a calculator on a website in a way designed to deceive visitors about whose business they are contacting;
- probe, overload, or interfere with the Service, attempt to access another customer's data, or resell the Service without our written agreement;
- submit content to the Service that infringes someone else's rights.
We may suspend or terminate accounts that violate this section. Where practical, we will warn you first.
10. Your content and our property
Calculators you build, rates you set, branding you upload, and leads collected for you are yours. You grant us the license needed to host, display, and process them to operate the Service. The Service itself — software, design, and everything that is not yours — is owned by Fuelviews, Inc. and protected by intellectual property laws.
11. Termination and your data
- You may close your account at any time.
- While your account is active, you can export your leads from the dashboard and by webhook.
- After closure or termination, you may request an export of your data by emailing [email protected] within 30 days. After that window we delete your data in the ordinary course, as described in the Data Processing Addendum.
- We may terminate for material breach, and we may suspend immediately where continued operation would harm visitors, other customers, or the Service.
12. Disclaimers
The Service is provided "as is" and "as available," without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted or error-free, or that any estimate, suggested rate, or regional adjustment is accurate.
13. Limitation of liability
To the maximum extent permitted by law, Fuelviews, Inc. will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, or data. Our total liability for all claims arising out of or relating to the Service is limited to the amounts you paid us in the twelve months before the event giving rise to the claim or, if you have paid nothing, one hundred US dollars.
14. Indemnity
You will indemnify and hold harmless Fuelviews, Inc. and its officers, employees, and agents from claims arising out of your use of the Service, your calculators and estimates, your contact with leads, or your breach of these Terms — including claims that you contacted a person without the consent the law requires.
15. Dispute resolution
Any dispute arising out of these Terms or the Service that cannot be resolved informally will be settled by binding arbitration on an individual basis, conducted remotely, rather than in court — except that either party may bring a qualifying claim in small-claims court, and either party may seek injunctive relief for infringement or misuse of intellectual property in a court of competent jurisdiction. You and Fuelviews each waive the right to a jury trial and to participate in a class action. You may opt out of this arbitration provision by emailing [email protected] within 30 days of first accepting these Terms.
16. Governing law
These Terms are governed by the laws of the State of Delaware, without regard to conflict of law principles.
17. Changes to these Terms
Every version of these Terms is archived and permanently available. If we make material changes, we will notify you by email or in the dashboard before they take effect; continued use after the effective date is acceptance. The version you accepted is recorded with your account and always resolves to its exact text.
